Terms and Conditions of Sale
These Tracts of land and timber shall be sold on an "as is" basis. The property is being sold by legal description and it is understood that any acreage referenced are neither guaranteed nor warranted by Seller or Agent. All maps, plats, etc. are provided for assistance to prospective bidders. All information is believed to be accurate; however no warranty is expressed or implied. All prospective bidders should conduct their own investigation, inspection, and come to their own conclusions concerning acreage, value, timber volumes, mineral interest, etc.
The "Successful Bidder" will be notified within (4) days of the bid sale. The "Successful Bidder" will be required to enter into a contract agreement, for Sale and Purchase of Real Property with Seller, within four (4) working days of notification of acceptance of bid. A 5% bid deposit will be required at bid opening. A Sale and Purchase agreement will be furnished upon request. Any alterations to the agreement must be approved by the Seller prior to the bid opening. Property taxes will be prorated as of the day of closing. The Seller will convey property in title by a Statutory Warranty Deed. Closing will be on or before December 30, 2008. Any change in the closing will be a date mutually agreed upon by both the Seller and Buyer.
Inspection of Property
Inspection: Prospective bidders, inspecting the sale property, may enter at their own risk any time prior to the bid date. All prospective bidders inspecting the property agree, for and in the consideration of The Property Owner grant of permission to enter for the purpose of inspection, to release and hold harmless The Property Owner and Tutt Real Estate LLC from any liability for claims, injuries, or damages arising from bidder's inspection.
Bid Opening
Bids will be accepted on a (Lump Sum) sealed bid basis for all Land and Timber. No bids will be accepted on a per acre basis. Sealed bids should be delivered or mailed to Tutt Real Estate LLC 2000, South Main Street, Linden, Alabama 36748. Bids will be accepted by fax at 334-295-1170, but will require a signature and phone call verification at 334-295-1146 ext.22. All bids, faxed or mailed, should be received the day prior to the bid date. All bids should be submitted on the bid form, included in this package, in a sealed envelope clearly marked "+/- 315 Acres Pike County".
All Bidders are welcome to attend a public bid opening at 2:00 p.m. CST, Tuesday, December 9, 2008 at Tutt Real Estate LLC office, 2000 South Main Street, Linden, Alabama. No bids will be accepted after the stated bid time of 2:00 p.m. CST. Tutt Real Estate LLC will accept bids from agents or real estate brokers on behalf of their clients, but will pay no sales commissions for their representation. |
